WA’s Yindjibarndi traditional owners consider appeal against Fortescue’s $150m record native title payout | Fortescue

0

Yindjibarndi traditional owners are considering an appeal against the federal court’s record $150m compensation payout, saying it is “unsatisfactory” and will not cover the cultural and financial losses suffered since Fortescue began mining their land.

On Tuesday, mining company Fortescue was ordered by the federal court to pay compensation to Yindjibarndi traditional owners for cultural losses caused by its multibillion‑dollar Solomon Hub iron ore mine, plus $100,000 for economic losses – the largest compensation payout in native title history.

Federal court justice Stephen Burley ruled in favour of the Yindjibarndi traditional owners, recognising their deep cultural ties to country and the trauma caused by the billion‑dollar mining operations. But the court’s finding on economic loss fell well short of what YNAC’s legal team had argued for.

The Yindjibarndi Ngurra Aboriginal Corporation (YNAC) launched the compensation claim in 2022 and sought $1.8bn, including $1bn for cultural damage, $678m for economic loss, $34.85m for the destruction of sites and $112.13m for social disharmony allegedly caused by Fortescue. The company sought to cap the compensation at $8m, while the WA government argued that between $5m and 10m would be appropriate.

The Yindjibarndi people gained exclusive native title rights to their land, including the area where the Solomon Hub mine sits, in 2017 after first filing a native title claim in 2003.

YNAC’s chief executive officer and lead applicant, Michael Woodley, said while the judgment was welcomed, it was also “unsatisfactory” because it calculated the value of the loss based on freehold land value rather than the royalties paid by mining companies in the region established by native title agreements.

“Instead, in its judgment, the court, followed the precedent set by the 2018 high court case at Timber Creek in the Northern Territory, for which economic losses were assessed based on freehold land value.

“Given this, the headline amount that the court arrived at is unsatisfactory in the context of what has been lost,” Woodley said.

The Yindjibarndi traditional owner said that for his people, self-determination over their way of life, opportunities and economic activity is vital. “[It] means being able to determine and dictate how we continue to live our lives and how we grow our own nation through those opportunities that are being created and developed from our Ngurra [country].”

The mine, which has extracted millions of tonnes of iron ore over the past decade, has generated an estimated $80bn in revenue for Fortescue since operations began, but was approved by the Western Australian government without the permission of Yindjibarndi traditional owners.

Woodley said they were disappointed at the Western Australian government’s decision to side with the mining giant.

“The state government could have adopted a neutral position on the amount of compensation in this case and left the other parties to fight this out in court, but instead it argued against the Yindjibarndi,” Woodley said in a statement released on Thursday.

On Tuesday speaking outside the Perth courthouse, flanked by elders and community members who had travelled more than 1,500km south, Woodley told reporters that the decision was a “win” for Indigenous peoples in that the judge had expressed a deep understanding of the local people’s connection to their land and its spiritual and social ties to Country.

He said their legal team are reviewing the judgment and their battle for their land recognition and rights is continuing.

“We don’t get this far and stop.” Woodley said. “We’ll review it, we fight it. We’ve been fighting all our lives. I think the recognition needs to stand firm that this is our country. We’ve been here for a long, long time. We’re not going nowhere.”

In a statement, Fortescue said it would be reviewing the judgment reasonings when available by the court.

In the 2025 financial year, Fortescue reported revenue of US$15.5bn in its yearly update with profits of US$3.4bn.

Angela Rayner cleared by HMRC over tax affairs paving the way for potential leadership bid | Angela Rayner

0

Angela Rayner has been cleared by HMRC of deliberate wrongdoing or carelessness over her tax affairs, the Guardian can reveal, paving the way for a potential leadership bid as Keir Starmer’s grip on power unravels.

The former deputy prime minister has settled £40,000 in unpaid stamp duty after initially paying the lower rate, but has not paid any penalty as a result of the investigation. HMRC was also satisfied there was no tax avoidance.

In an interview with the Guardian, Rayner said she had been “bruised” by the whole experience because of the intrusion into her disabled son’s personal life, but also because it had appeared as though she was “in it for myself” rather than on the side of ordinary people.

The investigation by HMRC into her tax affairs has hung heavily over the senior Labour MP since she was forced to resign from the cabinet last September. Now it has been resolved, the door is open for a return to frontline politics.

Rayner indicated she may run in the event of a contest, saying she wanted to “play my part” and that she understood why Labour MPs were so upset following last week’s election crushing. She said Starmer should “reflect on” stepping aside.

With Labour on the brink of civil war, Wes Streeting, the health secretary, is preparing to launch a leadership challenge on Thursday if he and his allies can secure the support of enough MPs to trigger a contest.

His move to force a race has sparked a frantic scramble on the left of Labour to find a candidate to oppose him, with Ed Miliband and Rayner both possible contenders, while Andy Burnham is unable to run from outside parliament.

Rayner suggested she could enter any leadership contest, should one be triggered by Streeting on Thursday, although sources have said she was not dead set on being the left’s candidate.

“I’ll play my part in doing everything we possibly can to deliver the change, because it’s not a personal ambition, I know the difference it makes,” she said when asked.

“Whatever role I can play, I will keep pushing and pushing hard because I want the people out there at the moment who are really struggling … to know that I’m putting all my energy into fighting for them.”

Rayner did not rule out endorsing a soft left rival if they had a better chance of success in any contest, raising the prospect of potential candidates on her wing of the party agreeing who would represent them.

“I don’t think it’s a case of each person for themselves, but I do think it’s a case of people seeing how they can pull the party together and have the vision to take us forward. You have to play your role as part of a team,” she said.

But Starmer’s former deputy ruled out launching a coup herself. “I’ve made it clear that I wasn’t going to trigger the prime minister – and that I want to see change. I want to see actions, not just words.”

Rayner declined to say whether Starmer should fight any leadership challenge, saying that was a matter for the prime minister. When pressed on whether he should step aside, she said: “Keir will have to reflect on that.”

She added: “I’ve said to Keir this is a really significant moment for our party and the country … The pace of change hasn’t been enough for voters to see, and also mistakes have really blown us off course and made voters doubt us.”

Streeting has been organising an attempt to oust Starmer for days since Labour’s disastrous election results, which Rayner said had left many MPs – including herself – “heartbroken” at losing longstanding councillors.

“Whatever Wes is doing, he has to justify his actions,” she said. “I do understand my colleagues and why they’re they’re angry and upset … I do understand why we’re having this conversation now, but we need to get through that as quickly as possible.”

Rayner again stressed that Burnham should not have been prevented from re-entering parliament.

“If somebody wants to come and help, and be part of the future that we can deliver, then absolutely we shouldn’t be blocking people … We cannot afford to be factional about this. We cannot afford to have egos,” she said.

But when asked, she said it would not be appropriate for her to ask Labour MPs in the north-west to stand down from their seats so that he could run.

Rayner’s last eight months have been overshadowed by the HMRC investigation, which was initiated after it emerged she had underpaid stamp duty on a Hove flat that she bought when her son’s trust bought her out of the family home.

“I felt that voters were left with the impression that I somehow tried to avoid – or worse had been reckless or careless – in my actions. Whereas now hopefully people can see that actually it’s a really complex area of law,” she said.

But she acknowledged that some people would still feel uncomfortable about a former housing secretary paying the standard rate of stamp duty, when HMRC said she should pay the higher one.

“Yeah, I understand that, but this is a very complex area of tax. It’s ambiguous and I did get advice at the time. Therefore I felt like I’d done everything I could to ensure that I complied,” she said.

However, she says the investigation had “clipped my wings” because it made people feel she wasn’t “on their side”. She added: “That hurt the most, yeah, because that’s what I’ve always fought for.”

Rayner consulted two leading tax lawyers on her affairs and they reached two different conclusions. One advised her she would have a “realistic chance” of successfully appealing against HMRC’s decision but that it could take years. She accepted the decision and paid the tax.

“Politicians should be held up to high standards and that’s why, when there was a question mark, I resigned from government. I think that was the right thing to do,” she said.

“It was just the constant digging and then headlines of ‘I avoided tax’, ‘I didn’t want to pay the tax’, or that ‘I’d taken money from my son’, all these insinuations, all these things that were not accurate.

“I’m relieved because the one thing that has really upset me is that the public thought in some way that I had either been careless, or that I’d tried to avoid paying tax, when both of those things are clearly not right.”

CIA raided Tulsi Gabbard’s office? The Intelligence Chief’s office termed the sensational claims as false, know what it said?

A Fox News report on the raid by the American intelligence agency CIA on the office of Director of National Intelligence (DNI) Tulsi Gabbard created a sensation. However, National Intelligence Press Secretary Olivia Coleman has termed these reports as completely false. He said on social media, ‘This is completely wrong, CIA has not conducted any raid.’

What is the whole matter?

According to the news, CIA agents have seized dozens of boxes from Gabbard’s office. It was claimed that these boxes contained confidential files related to the assassination of John F. Kennedy and the CIA’s controversial ‘mind control program’. Tulsi Gabbard was in the process of making these files public. However, controversy has increased over this news, the press secretary of National Intelligence rejected this report as false.

According to the report of Fox News, the allegations of this alleged raid conducted by the CIA came to light for the first time during the hearing of the ‘Senate Homeland Security Committee’ on Wednesday (May 13). Whistleblower James Erdman III claimed that preparations were underway to declassify those files, when the CIA allegedly intervened and took them into their possession.

According to ANI report, US MP Anna Paulina Luna has warned that if the CIA does not return the boxes of files taken from the office of the Director of National Intelligence (DNI), then she will issue summons to them. Luna said on social media that the CIA had only 24 hours to return the files. These files should be returned to the office of Intelligence Director Tulsi Gabbard.

Philippines authorities investigating reports lawmaker wanted by ICC has fled after taking refuge in senate | Philippines

0

Philippine authorities are seeking to confirm reports that a lawmaker wanted by the international criminal court (ICC) secretly left the Senate premises where he had spent days evading arrest, an official said.

Presidential communications undersecretary Clare Castro told a press conference that authorities were trying to confirm the whereabouts of senator Ronald dela Rosa, after reports suggested he had slipped out of the heavily guarded building undetected before dawn.

“We are still getting official confirmation,” she told media, adding there had been no operations launched so far to arrest him.

Ronald dela Rosa, a senator who is wanted by the ICC for his role in overseeing former president Rodrigo Duterte’s “war on drugs”, avoided arrest earlier this week after he dramatically outran government agents and was offered protective custody by allies in the senate chamber.

Further chaos erupted in the senate on Wednesday night when gunshots were fired, forcing journalists to scramble for cover.

Dela Rosa had earlier said his arrest was imminent and called for supporters to gather outside the senate to protect him.

Philippines president Ferdinand Marcos later said no government personnel had been involved in the incident in the senate and there were no instructions to arrest Dela Rosa. He questioned whether the event was an attempt to “destabilise the government or trigger chaos”.

An investigation into the shooting is ongoing. Police said on Thursday they had detained a person in connection with the incident. Philippine police spokesperson Brigadier-General Randulf Tuano said the man was apprehended on the second floor of the senate building.

Interior secretary Juanito Victor Remulla had said senate security fired “warning shots” at several unknown armed men who had gone up the senate stairway.

Dela Rosa was head of the Philippine national police during Duterte’s administration and was a chief enforcer of anti-drugs crackdowns in which thousands of people were killed.

He is one of eight co-perpetrators named by the ICC in their case against Duterte, who is now detained at The Hague. An arrest warrant accuses him of “authorising, condoning and promoting” drug war killings, providing weapons, promising impunity and rewarding perpetrators, according to an ICC arrest warrant that was unsealed on Monday.

He did not respond to a request for comment, but has denied wrongdoing.
