A federal judge on Tuesday blocked the Trump administration from re-arresting Salvadoran migrant Kilmar Abrego Garcia into federal immigration custody — an update that comes just days before he is slated to appear in Nashville for a key court date in a separate criminal case.

U.S. District Judge Paula Xinis agreed to convert her previous emergency order blocking ICE from immediately re-detaining Abrego Garcia into a longer-term form of injunctive relief sought by his lawyers.  

She said Tuesday that the Trump administration failed to provide the court with any “good reason to believe” that they plan to remove him to a third country in the “reasonably foreseeable future.” Instead, she said, they “made one empty threat after another to remove him to countries in Africa with no real chance of success.”

The order clears the way for Abrego Garcia to participate in a key hearing in Nashville next week on whether a separate federal judge should dismiss his criminal case on the grounds of “vindictive” and selective prosecution.

Xinis also said the government has “done nothing” to show the court that Abrego Garcia’s continued detention in ICE custody is “consistent with due process.”

“Respondents have done nothing to show that Abrego Garcia’s continued detention in ICE custody is consistent with due process,” Xinis said Tuesday. 

She ticked through a list of the Trump administration’s efforts to remove Abrego Garcia to a four third countries in Africa country in the months between August, when Abrego was re-detained by ICE, and December, when Xinis ultimately ordered his release.

The Justice Department and Department of Homeland Security did not immediately respond to Fox News Digital’s request for comment. 

Xinis said Tuesday that the administration “refused to procure Abrego Garcia’s immediate removal to Costa Rica,” the location he had identified as his preferred third country of removal, in favor of what she said was attempted “phantom removals” by the government to send Abrego to “three (maybe four) African countries.”

“Indeed, since Abrego Garcia secured his release from criminal custody in August 2025, respondents have made one empty threat after another to remove him to countries in Africa with no real chance of success,” Xinis said.

The Trump administration previously tried and failed to remove Abrego Garcia to the African countries of Liberia, Eswatini, Uganda and briefly, Ghana.

Xinis noted in late November that the government could not take any of those steps without the final notice of removal order, which she reiterated Tuesday in the memo order that the government had not obtained. 

“Thus, he must remain on the stringent release conditions already imposed by ICE and in the Tennessee Criminal Matter,” Xinis said.

Abrego Garcia’s status has been at the center of a legal and political maelstrom since March, when he was deported to his home country of El Salvador, in violation of a 2019 court order and in what Trump officials acknowledge was an “administrative error.” Xinis ordered then that Abrego Garcia be “immediately” returned to the U.S.

He was eventually returned to the U.S. in June, where he was taken into federal custody in Nashville and detained on human smuggling charges stemming from a 2022 traffic stop. 

The Justice Department later told Xinis it had opened the criminal investigation and presented it to a grand jury at the same time that Abrego Garcia was detained in a Salvadoran prison, and at the same time as government lawyers were telling the court that the U.S. was powerless to order his return.

Next week’s hearing in Nashville will be centered on a motion to dismiss Abrego Garcia’s criminal case for “vindictive” and selective prosecution. 

The judge overseeing that case, U.S. District Judge Waverly Crenshaw, had ruled in October that Abrego Garcia had established a “reasonable likelihood” that the criminal case against him was the result of vindictive prosecution by the Justice Department.

Crenshaw had ordered the Trump administration to produce for the court internal documents and government witnesses to testify about its decision to bring the case.

Senior DHS and Justice Department officials previously suggested they would appeal Xinis’s orders. Trump officials have been sharply critical of Xinis and other federal judges presiding over deportation cages, whom they have repeatedly accused of overstepping their authority as a district judge.

“This order lacks any valid legal basis, and we will continue to fight this tooth and nail in the courts,” DHS Assistant Secretary Tricia McLaughlin said in response to the court’s earlier emergency order.

Chinese hackers exploiting Dell zero-day flaw since mid-2024

A suspected Chinese state-backed hacking group has been quietly exploiting a critical Dell security flaw in zero-day attacks that started in mid-2024.

Security researchers from Mandiant and the Google Threat Intelligence Group (GTIG) revealed today that the UNC6201 group exploited a maximum-severity hardcoded-credential vulnerability (tracked as CVE-2026-22769) in Dell RecoverPoint for Virtual Machines, a solution used for VMware virtual machine backup and recovery.

“Dell RecoverPoint for Virtual Machines, versions prior to 6.0.3.1 HF1, contain a hardcoded credential vulnerability,” Dell explains in a security advisory published on Tuesday.

“This is considered critical as an unauthenticated remote attacker with knowledge of the hardcoded credential could potentially exploit this vulnerability leading to unauthorized access to the underlying operating system and root-level persistence. Dell recommends that customers upgrade or apply one of the remediations as soon as possible.”

Once inside a victim’s network, UNC6201 deployed several malware payloads, including newly identified backdoor malware called Grimbolt. Written in C# and built using a relatively new compilation technique, this malware is designed to be faster and harder to analyze than its predecessor, a backdoor called Brickstorm.

While the researchers have observed the group swapping out Brickstorm for Grimbolt in September 2025, it remains unclear whether the switch was a planned upgrade or “a reaction to incident response efforts led by Mandiant and other industry partners.”

Targeting VMware ESXi servers

The attackers also used novel techniques to burrow deeper into victims’ virtualized infrastructure, including creating hidden network interfaces (so-called Ghost NICs) on VMware ESXi servers to move stealthily across victims’ networks.

“UNC6201 uses temporary virtual network ports (AKA “Ghost NICs”) to pivot from compromised VMs into internal or SaaS environments, a new technique that Mandiant has not observed before in their investigations,” Mandiant communications manager Mark Karayan told BleepingComputer.

“Consistent with the earlier BRICKSTORM campaign, UNC6201 continues to target appliances that typically lack traditional endpoint detection and response (EDR) agents to remain undetected for long periods.”

The researchers have found overlaps between UNC6201 and a separate Chinese threat cluster, UNC5221, known for exploiting Ivanti zero-days to target government agencies with custom Spawnant and Zipline malware and previously linked to the notorious Silk Typhoon Chinese state-backed threat group (although the two are not considered identical by GTIG).

GTIG added in September that UNC5221 hackers used Brickstorm (first documented by Google subsidiary Mandiant in April 2024) to gain long-term persistence on the networks of multiple U.S. organizations in the legal and technology sectors, while CrowdStrike has linked Brickstorm malware attacks targeting VMware vCenter servers of legal, technology, and manufacturing companies in the United States to a Chinese hacking group it tracks as Warp Panda.

To block ongoing CVE-2026-22769 attacks, Dell customers are advised to follow the remediation guidance shared in this security advisory.

11 dead after US forces strike alleged drug boats in the Pacific and Caribbean | US News

Strikes have been launched by US forces on three alleged drug smuggling boats in the eastern Pacific and the Caribbean, killing 11 people.

US Southern Command posted a video on X of Monday’s operation, along with a statement that “intelligence confirmed the vessels were transiting along known narco-trafficking routes and were engaged in narco-trafficking operations”.

The strikes are the latest in a series of controversial military operations which have brought the number of so-called “narcoterrorists” killed to at least 145 people since early September 2025.

Like most of the military’s statements on the 42 known strikes, US Southern Command said it targeted alleged drug traffickers along known smuggling routes.

It alleged the three boats were “operated by designated terrorist organisations”.

Two vessels carrying four people each were struck in the eastern Pacific Ocean, while a third boat with three people was hit in the Caribbean Sea.

The military posted videos showing the boats being destroyed.

Donald Trump said the US is in “armed conflict” with cartels in Latin America and has justified the attacks as a necessary escalation to stem the flow of drugs.

In a post on X, US defence secretary Pete Hegseth praised the strikes: “Turns out President’s Day – under President Trump – is not a good day to run drugs.”

The military has not provided evidence that the boats or people killed on Monday were involved in drug trafficking.

In January, the US launched a direct military attack on Venezuela, extraditing Nicolas Maduro and his wife Cilia Flores, transporting them both to New York to face narcoterrorism and other charges, which both deny.

Senate Republicans say they’ve struggled to get out on the campaign trail ahead of the midterm elections — and Senate Majority Leader John Thune, R-S.D., argues Democrats are to blame.

“Their whole goal, and everything is to, you know, force us to stay around, force us to try and get members to take hard votes and just to tie people down so that they can’t be back campaigning,” Thune told Fox News Digital.

Thune had just left a local furniture store in Sioux Falls, S.D., where he touted the economic benefits of the bill, which largely extended Trump’s tax cuts from his original 2017 tax bill, along with making tweaks to the tax code that lawmakers believe would directly benefit small businesses.

There, he noted that the owners of Montgomery’s told him, “If people had discretionary income out here, they spend it.”

That was the crux of the colossal bill Republicans rammed through Congress last year. In effect, it was a direct response to the pocketbook issues that largely drove the 2024 election cycle and propelled the GOP to a trifecta of federal control in Washington, D.C.

But time and again, Schumer and his caucus made it difficult for the GOP to get that message out, let alone leave the Capitol, Thune contended. Each day counts during campaign season, and canceling a travel plan or nixing an event can add up for Republicans seeking to stay in power.

The latest example is the now-four-day partial government shutdown, where an end doesn’t seem to be in sight as Senate Democrats and the White House engage in ongoing negotiations to fund the Department of Homeland Security (DHS).

While this closure hasn’t affected lawmakers’ travel plans — Thune has reminded the Senate to be ready at a moment’s notice should a deal be reached — the previous 43-day shutdown blew up any plans for lawmakers to get out and communicate with voters.

Then there was a carte blanche blockade against Trump’s nominees last year, too, that saw Thune cancel a portion of August recess. That time, particularly ahead of a midterm election cycle, is used by lawmakers to gin up early support for their reelection campaigns.

“Right now for [Democrats], it’s just all about — everything’s all about politics and making it, you know, really hard for our incumbents who are running for reelection,” Thune said.

Republicans see their ability to sell the “big, beautiful bill” as crucial to their election survival in November.

And once again, the cost of living and how the Trump administration has dealt with inflation will yet again be a prominent factor in the upcoming election, Thune said.

“I think most voters are, you know, especially the voters that are going to decide probably who controls the House and Senate after November, are going to be kitchen table-type, pocketbook … the bread and butter issues,” Thune said. “They’re economic voters, and so inflation is going to matter, and having more money in their pockets is going to matter.”

Jeri is the latest in a series of Peruvian presidents to be removed from office by an act of Congress, after Dina Boluarte and Pedro Castillo.

Just four months into his term, Peru’s President Jose Jeri has been removed from office.

The decision was the result of a Tuesday vote from Peru’s Congress, which debated multiple corruption allegations against Jeri’s government.

Jeri, a right-wing leader, was formerly the head of Congress. But in October, he took over the country’s presidency after his predecessor, Dina Boluarte, was impeached for “moral incapacity”.

Boluarte had replaced the last democratically elected president, Pedro Castillo, in December 2022 after he too was impeached.

Jeri was the seventh president in a decade to lead Peru. Many of his predecessors have been mired in scandal, forcing them to step down or face impeachment.

In Jeri’s case, the scandals largely concerned allegations that the right-wing leader was involved in influence-peddling. One of the most notable was informally dubbed “Chifagate”, after the Peruvian-Chinese fusion cuisine known as “chifa”.

“Chifagate” emerged after Peruvian media published video of Jeri attending a late-night meeting with a Chinese businessman, Zhihua Yang, at his restaurant in Lima. The meeting was not included on the official presidential agenda, as required under Peruvian law.

Jeri appeared to be in disguise in the video, wearing informal clothing including a deep hoodie that partially obscured his face, which spurred further questions about the nature of the meeting.

Subsequent images showed Jeri visiting another one of Yang’s businesses, a wholesale store, this time in sunglasses.

Jeri has repeatedly denied wrongdoing and has dismissed the meetings as get-togethers to discuss a Peruvian-Chinese friendship day — or simple shopping trips.

Essex Police are assessing information around private flights to and from Stansted Airport following the release of the Epstein files.

Former prime minister Gordon Brown last week called for UK police to “urgently” re-examine claims women or girls were trafficked to the country aboard flights.

In an article for the New Statesman, Mr Brown said the recently published files relating to Jeffrey Epstein showed the paedophile financier’s jet making 90 flights to or from UK airports, including 15 after his 2008 sex offence conviction.

A spokesperson for Essex Police said: “We are assessing the information that has emerged in relation to private flights into and out of Stansted Airport following the publication of the US DoJ Epstein files.”

Stansted Airport said: “All private aircraft at London Stansted operate through independent Fixed Base Operators, which handle all aspects of private and corporate aviation in line with regulatory requirements. All immigration and customs checks for passengers arriving on private aircraft are carried out directly by Border Force.

“They use entirely independent terminals not operated by London Stansted and no private jet passengers enter the main airport terminal. The airport does not manage or have any visibility of passenger arrangements on privately operated aircraft.”

Church explosion injures 5 people in Boonville, New York

New York State Police are investigating after five people were injured in an explosion at the Abundant Life Fellowship church in Boonville, New York.

Church leaders said their pastor and a congregation member were at the building and called first responders just before 10:30 a.m. local time to report “an obvious gas leak.”

While the pastor, congregant and a Boonville Fire Department firefighter were inside the building, an explosion occurred, according to the church and New York State Police.

Authorities said five people were taken to Wynn Hospital in Utica, with the Boonville firefighter and a civilian listed in critical condition.

Three others are being treated for injuries that are not believed to be life-threatening.

New York State Police said the church sustained “catastrophic damage,” and the church noted the building was nearly fully engulfed in flames and smoke within 15 minutes of the explosion. 

The church was reportedly heated by propane cylinders, but the exact cause of the explosion remains under investigation, according to police.

“Please just pray for peace, especially for Pastor Brandon and MaeLeah,” the church wrote in a Facebook post. “And go ahead and lift a lot of praise for the Lord’s protection over all the things NOT happening at church at the time of this emergency.”

New York Gov. Kathy Hochul responded to the tragedy on social media, noting she has been briefed.

“State Fire, EMS, and Office of Emergency Management personnel are on the scene,” Hochul wrote in an X post. “Praying for the full recovery of the five individuals injured.”

New York State Police and the Oneida County Sheriff’s Office did not immediately respond to additional inquiries from Fox News Digital.

European Parliament bars lawmakers from AI tools • The Register

The European Parliament has reportedly turned off AI features on lawmakers’ devices amid concerns about content going where it shouldn’t.

According to Politico, staff were notified that AI features on corporate devices (including tablets) were disabled because the IT department could not guarantee data security.

The bone of contention is that some AI assistants require the use of cloud services to perform tasks including email summarization, and so send the data off the device – a challenge for data protection.

It’s a unfortunate for device vendors that promote on-device processing, but the European Parliament’s tech support desk reportedly stated: “As these features continue to evolve and become available on more devices, the full extent of data shared with service providers is still being assessed. Until this is fully clarified, it is considered safer to keep such features disabled.”

The Register contacted the European Parliament for comment.

Data privacy and AI services have not been the greatest of bedfellows. Studies have shown that employees regularly leak company secrets via assistants, and on-device AI services are a focus of vendors amid concerns about exactly what is being sent to the cloud.

The thought of confidential data being sent to an unknown location in the cloud to generate a helpful summary has clearly worried lawmakers, which is why there is a blanket ban. However, the issue has less relevance if the process occurs on the device itself.

The Politico report noted that day-to-day tools, such as calendar applications, are not affected by the edict. The ban is temporary until the tech boffins can clarify what is being shared and where it is going.

The European Parliament has scrutinized AI over recent years and has enacted the world’s first legislation specifically designed to address perceived risks from the technology. The ban, alongside guidance to steer lawmakers away from using the services for Parliament business, is more about fears about where the data could end up than anything specific about AI.

The guidance also advised against granting third-party AI apps broad access to data, which seems a sensible instruction regardless of where a user works. ®

A United States federal judge has ruled that the administration of US President Donald Trump cannot re-detain Kilmar Abrego Garcia, a Salvadoran national who was wrongfully deported last year and who the federal government has sought to deport again.

US District Judge Paula Xinis stated on Tuesday that a 90-day detention period had passed without the administration presenting a workable plan to deport Abrego Garcia, whose lawyers say he is being punished because his wrongful detention embarrassed the government.

Xinis said that the government “made one empty threat after another to remove him to countries in Africa with no real chance of success”.

“From this, the court easily concludes that there is no ‘good reason to believe’ removal is likely in the reasonably foreseeable future,” he added.

The ruling is a victory for Abrego Garcia, who has been fighting his attempted deportation by US immigration authorities who have tried to send him to African nations such as Uganda, Eswatini, Ghana, and Liberia. Abrego Garcia was released from an immigration detention facility in December.

His wrongful deportation to El Salvador, where he was held in a prison known for poor conditions and widespread abuse, became an early flashpoint in the Trump administration’s push to deport non-citizens from the US, often with few efforts to abide by due process requirements. The Trump administration had also accused Abrego Garcia of being a member of the criminal group MS-13, without offering any evidence.

His mistaken deportation prompted widespread anger and calls for the Trump administration to bring him back to the US. After initially stating that it had no authority to do so, the Trump administration brought Abrego Garcia back to the US in June following a court order mandating his return. It has since charged him with human smuggling, an allegation that he denies.
