The Lucknow bench of the High Court in Prayagraj has given an important instruction regarding keeping parks, playgrounds and open spaces safe in Uttar Pradesh. The court has ordered all the Divisional Commissioners and concerned authorities of the state to prepare a complete list of all the parks, playgrounds and open spaces present in their respective areas. According to the information, these places should be registered under the Uttar Pradesh Park, Playground and Open Space Protection and Regulation Act 1975.

This comment of the court came at a time when it came to light during the hearing that despite this law of 1975 and the rules made in 2005, till now no complete official list of parks, playgrounds and open spaces has been prepared in the entire Uttar Pradesh. The court has asked the state government to ensure compliance with this order and complete details of all the places should be presented before the court.
This order was given by the bench of Justice Rajan Roy and Justice AK Chaudhary during the hearing of a PIL. This petition was filed by a person named Dharampal Yadav. In the petition, a demand was made to ban the alleged commercial use of Janeshwar Mishra Park.

The purpose of the law is to keep parks and playgrounds safe – court
During the hearing, the court said that the main objective of this law is to keep parks, playgrounds and open spaces safe and ensure their proper use. If these places are listed under the Act 1975, they can be used only for the purpose for which they were used before 1975.
The court also made it clear that if a park, playground or open space is to be used for any other purpose, it will be mandatory to obtain prior permission from the concerned authority. The next hearing of the case will be on April 10.
