According to Section 8 (3) of the Public Representation Act 1951, a person convicted cannot contest elections for 6 years. That is, Azam Khan himself cannot contest elections till 2028. Not only this, there is no stay or stay from any court on the case in which they were sentenced. In such a situation, it is impossible for Azam Khan to contest the 2027 election at the moment.

What is the situation of Abdullah?

A similar situation is with Azam’s son Abdullah. In the year 2022, his father Azam Khan first went to the legislative and then in the year 2023, Abdullah’s legislator went away. He was an MLA from Swar seat. Later the by -election was held on that seat. The 6 -year duration in Abdullah’s case is completed in 2029. In such a situation, both father and son cannot contest 2027 elections in the current situation.

Please tell Abdullah’s legislator has gone twice. For the first time on 16 December 2019, the Allahabad High Court canceled his election in terms of age -related forgery. His membership was considered zero from the same date. For the second time on 13 February 2023, the Moradabad MP-MLA court sentenced him to two years in a 2008 case, after which the Uttar Pradesh Assembly Secretariat canceled his membership and declared the Swar seat vacant.
