Federal judge signals skepticism as Kelly challenges Pentagon censure

A federal judge on Tuesday appeared receptive to the claim from Sen. Mark Kelly, D-Ariz., that the Pentagon is retaliating against him for protected political speech, raising concerns about potential violations of the First Amendment.

U.S. District Court Judge Richard Leon is considering whether to issue a preliminary injunction that would halt War Secretary Pete Hegseth’s efforts to reopen Kelly’s military retirement grade, a process that could result in a reduction of his pension, while the case proceeds.

“You don’t need a weatherman to see which way the wind is blowing,” Leon said, invoking Bob Dylan and suggesting he needed little additional information to determine whether Kelly’s First Amendment rights were violated.

The case stems from a video posted on social media in November in which Kelly and five other Democratic lawmakers told members of the U.S. military to refuse illegal orders.

Hegseth issued a letter of censure against Kelly on Jan. 5, accusing him of undermining the chain of command, counseling disobedience, and engaging in conduct unbecoming an officer.

Kelly sued Hegseth days later, arguing the censure and effort to reopen his military retirement grade amounted to unconstitutional retaliation for protected political speech.

Kelly’s defense team argued in court that the situation is unprecedented, and that Hegseth is “openly admitting they are punishing a decorated war veteran and senator” for exercising his First Amendment rights.

Justice Department lawyers arguing for Hegseth contended that Kelly is still subject to the Uniform Code of Military Justice as a retired officer, and that his comments undermined order and discipline within the armed forces.

They also suggested an injunction from the judge could take power away from the government to administer personnel matters in its own military.

Judge Leon did not rule from the bench but acknowledged that he knew Kelly was up against looming deadlines and would make an effort to issue a ruling in the coming days.

Kelly said after the high-stakes hearing that the case is not only about his First Amendment rights, but those of all retired military personnel.

“Since taking office, this administration has repeatedly gone after the First Amendment rights of Americans,” he said. “That’s not how we do things in the United States of America. We have the Constitution and the law on our side.”

Microsoft rolls out native Sysmon monitoring in Windows 11

Windows utility

Microsoft has started rolling out built-in Sysmon functionality to some Windows 11 systems enrolled in the Windows Insider program.

Microsoft first revealed plans to integrate Sysmon natively into Windows 11 and Windows Server in November, when it also confirmed that it will soon release detailed documentation.

Sysmon (short for System Monitor) is a free Microsoft Sysinternals tool (and a Windows system service and device driver) that monitors for and blocks malicious/suspicious activity, logging it to the Windows Event Log.

While it monitors basic events, such as process creation and termination, by default, it can also be configured to monitor more complex behavior, including executable file creation, process tampering, Windows clipboard changes, and even automatically backing up deleted files.

Although Sysmon is a very popular tool for diagnosing persistent Windows issues and for threat hunting, it normally needs to be installed manually on each device, which makes it harder to manage and deploy in large IT environments.

“Windows now brings Sysmon functionality natively to Windows. Sysmon functionality allows you to capture system events that can help with threat detection, and you can use custom configuration files to filter the events you want to monitor,” the Windows Insider program team announced on Tuesday.

“The captured events are written on the Windows event log, enabling them to be used with security applications and a wide range of use cases.”

Although Sysmon is now natively supported in Windows, it’s disabled by default, and users must explicitly enable it through the following procedure (it’s important to note that you must uninstall the Sysmon installed from the website before enabling the built-in Sysmon):

  1. Go to Settings > System > Optional features > More Windows features > checking Sysmon or in PowerShell or command prompt:
  2. Run the following command from PowerShell or the Command Prompt to complete the installation:

The new optional Sysmon capabilities are rolling out to Windows Insiders in the Beta and Dev channels who have installed Windows 11 Preview Build 26220.7752 (KB5074177) and Windows 11 Preview Build 26300.7733 (KB5074178), respectively.

Last month, Microsoft also began testing a new policy that allows IT admins to uninstall the AI-powered Copilot digital assistant from managed devices.

Modern IT infrastructure moves faster than manual workflows can handle.

In this new Tines guide, learn how your team can reduce hidden manual delays, improve reliability through automated response, and build and scale intelligent workflows on top of tools you already use.

Former U.S. Capitol Police officer Harry Dunn, who served during the Jan. 6, 2021, Capitol riot, is running for U.S. Congress again after a 2024 bid fell flat.

“I will never forget that day. The shouting. The pounding. The sound of glass breaking. The shattering of American democracy. January 6 was violent, lawless. A lie turned into an attack,” Dunn declared in a campaign video. “And Donald Trump lit the fuse. And he never put the match down.”

NBC News reported that Dunn has said U.S. Immigration and Customs Enforcement must be “abolished.”

Notepad++ Official Update Mechanism Hijacked to Deliver Malware to Select Users

0

Ravie LakshmananFeb 02, 2026Threat Intelligence / Malware

Notepad Hacked

The maintainer of Notepad++ has revealed that state-sponsored attackers hijacked the utility’s update mechanism to redirect update traffic to malicious servers instead.

“The attack involved [an] infrastructure-level compromise that allowed malicious actors to intercept and redirect update traffic destined for notepad-plus-plus.org,” developer Don Ho said. “The compromise occurred at the hosting provider level rather than through vulnerabilities in Notepad++ code itself.”

The exact mechanism through which this was realized is currently being investigated, Ho added.

The development comes a little over a month after Notepad++ released version 8.8.9 to address an issue that resulted in traffic from WinGUp, the Notepad++ updater, being “occasionally” redirected to malicious domains, resulting in the download of poisoned executables.

Specifically, the problem stemmed from the way the updater verified the integrity and authenticity of the downloaded update file, allowing an attacker who is able to intercept network traffic between the updater client and the update server to trick the tool into downloading a different binary instead.

It’s believed this redirection was highly targeted, with traffic originating from only certain users routed to the rogue servers and fetching the malicious components. The incident is assessed to have commenced in June 2025, more than six months before it came to light.

Independent security researcher Kevin Beaumont revealed that the flaw was being exploited by threat actors in China to hijack networks and deceive targets into downloading malware. The attacks, attributed to a nation-state threat actor known as Violet Typhoon (aka APT31), targeted telecommunications and financial services organizations in East Asia.

In response to the security incident, the Notepad++ website has been migrated to a new hosting provider with “significantly strong practices,” and the update process has been hardened with additional guardrails to ensure its integrity.

“According to the former hosting provider, the shared hosting server was compromised until September 2, 2025,” Ho explained. “Even after losing server access, attackers maintained credentials to internal services until December 2, 2025, which allowed them to continue redirecting Notepad++ update traffic to malicious servers.”

Anti-Trump comedian Kathy Griffin accused podcast giant Joe Rogan of being a “right-wing guy” who she claimed was convincing men not to get vaccinated.

While appearing on the “In Your Dreams With Owen Thiele” podcast Friday, Griffin recounted an interaction with a critic on the street who peppered her with what she called “Joe Rogan-talking points.”

“He’s trying to convince me of all of Joe’s, like, conspiracy theories and all of his weird supplements and his popping veins,” Griffin said.

Griffin described knowing Rogan as a comic “back in the day” and claimed he has since turned into someone who “platforms right-wing people” and spreads conspiracies.

“I knew Joe back in the day when he had hair and was a comic and I liked him, and he was nice, but now he’s turned into this really powerful, very much — he doesn’t say it but — right-wing guy who platforms right-wing people, and bros really believe him,” Griffin said. “The straight bros, they are not getting vaccinated because of Dr. Joe Rogan.”

While Griffin accused Rogan of being a “right-wing guy,” the “Joe Rogan Experience” host has a mixed political history. Rogan previously endorsed Sen. Bernie Sanders during the 2020 Democratic primary and has hosted a range of guests from across the political spectrum, including Texas Democratic state Rep. James Talarico, whom he once encouraged to consider a presidential run.

Griffin’s comments on Rogan came days after she encouraged her fans to identify their “MAGA” neighbors to know “who’s on our team.”

“I live in Los Angeles. It’s happening at targeted places in Los Angeles,” Griffin said on her show “Talk Your Head Off with Kathy Griffin.” “And I think it’s time to talk to the neighbors in real life. It’s time to talk to your neighbors, find out if they’re MAGA or not.”

“Sorry, but we have to know who’s on our team and start to plan,” Griffin said. “Is there a way we can do something as a community? When I hear from my followers in Minnesota, they describe a very sophisticated channel of a system of things that they do to help one another. And they use encrypted apps and, like I said, everyone has whistles and honks their horn, but they organize in small groups.”
