
Saket Court has reserved its verdict on the bail plea of a couple arrested for allegedly making racial remarks against women from North East in Malviya Nagar area of South Delhi. The court will give its order on this on Tuesday (March 10). The court of Additional Sessions Judge Samar Vishal reserved the order after hearing the arguments of both the parties. In this case, accused Harsh Priya Singh and Ruby Jain were arrested by Delhi Police on 25 February. He is accused of abusing three women from Arunachal Pradesh and Manipur. The video of this incident also went viral on social media.
Neighbors’ quarrel was exaggerated – lawyer
During the hearing in Saket court, lawyer Gaurav, appearing for the accused, argued that this case is only about a dispute between neighbours, which is being exaggerated. He said that objectionable language was used during the debate between both the parties but it cannot be considered a case of racial discrimination. The lawyer also said that the accused were not aware that the complainant women belonged to the tribal community, hence the SC/ST (Prevention of Atrocities) Act did not apply. The lawyer argued that the dispute took place inside a rented house, which does not fall under the category of public place according to law.
The accused themselves called the police control room – lawyer
The defense also said in the Saket court that after the incident, the call to the police control room was made by the accused themselves because they too were scared of the language of the other party. According to him, all the evidence related to the case is with the police and the accused have already cooperated in the investigation, hence there is no need to keep them in custody now. Raising the issue of Ruby Jain’s health, the lawyer said that she is not being treated properly in jail. She also demanded from the court to grant special bail on the basis of her being a woman.
Opposition to bail of accused couple
At the same time, the lawyer appearing on behalf of complainant Liyi Noshi opposed the bail. He said that the investigation of the case is still going on and the accused can influence the witnesses if they get bail. He told that an important eyewitness, who was an electrician who had come to install the AC at that time, is still under investigation. The complaining party also alleged that after the incident, the accused had tried to pressure the women into agreement. He was called to the landlord’s house and asked to calm down the matter.
The lawyer told the court that after the incident, there is concern about the safety of women. The situation became such that a girl from Manipur had to leave Delhi and return to her home. At present, the court has reserved its decision on the bail petition after hearing the arguments of both the parties and now the order will be pronounced on Tuesday.
