Rebel MLAs can escape from anti-defection law

Under the anti-defection law, any splinter group needs the support of at least two-thirds of the members of the legislative party to avoid disqualification. TMC has 80 MLAs in the assembly, so this figure comes to 54. If the rebel group’s claim of support of 58 MLAs proves true, it will be in a strong position to get itself recognized as a legitimate TMC legislature party by garnering more support than the required number. Although the support of only 30 MLAs is enough to claim the post of Leader of the Opposition, the current struggle does not seem to be limited to this post only. The real fight is believed to be over the control of the legislative party and the rights over the election symbol.

After his arrival in the Assembly, discussions intensified in political circles that he has the support of about two-thirds of the party’s MLAs and he is preparing to challenge the current leadership. Sources in the rebel camp claim that Ritabrata Banerjee has letters of support from 58 MLAs and he can demand recognition for both the posts of leader of the TMC legislature party and leader of the opposition.

CM Shubhendu said – No person committing fraud will be spared

Amidst this political controversy, CM Shubhendu Adhikari has also made a scathing attack on the TMC leadership. Regarding the alleged fake signature and internal correspondence controversy, he said that the law will take its course in the matter and no one involved in signature forgery will be spared.

Giving details of the incident, Shubhendu Adhikari said that on May 9, TMC’s national general secretary had sent a letter to the Assembly Speaker and proposed to appoint Shobhandeb Chattopadhyay as the leader of the opposition, Nayana Bandyopadhyay and Asima Patra as deputy leaders and Firhad Hakim as the chief whip. After this, another letter with 70 signatures was sent on 20 May. However, the controversy escalated when TMC MLAs Ritabrata Banerjee and Sandipan Saha filed a formal complaint alleging that no such resolution was passed by the legislature party.

After the intervention of the Assembly Speaker, an FIR was registered at Hare Street police station and the investigation of the case was later handed over to CID. CM Shubhendu Adhikari claimed that CID has started collecting signature samples of the MLAs included in the letter. According to him, three TMC MLAs Baharul Islam, Arup Roy and Subhashish Das have admitted before the CID that they had not signed the relevant document.

Rebellion in TMC started from a fake signature scandal

This entire controversy started over the letter which TMC had submitted to the Assembly Secretariat. This letter had signatures of about 70 MLAs in support of making Shobhandeb Chattopadhyay the Leader of Opposition. However, expelled party MLAs Ritabrata Banerjee and Sandipan Saha alleged that their signatures in the support letter were fake. Apart from these, signatures of many other MLAs were also found suspicious. After this the party expelled Ritabrata Banerjee and Sandipan Saha from the party.

The complaint of the Assembly Secretariat said that the signature of TMC leader Naina Banerjee was found to be the most suspicious. His signature at the time of taking oath and the signature present in the supporting letter were said to be different. After this CID started investigation and interrogated many MLAs. These include leaders like Naina Banerjee, Chandranath Sinha, Kunal Ghosh and Baharul Islam.
