In a relief to the LDF government of Kerala, the Supreme Court on Tuesday stayed the High Court’s decision which had quashed the order of giving Rs 20 crore for the ‘Nav Kerala Citizen Response Programme’. Under the Nava Kerala Citizen Response Programme, people will be made aware about the government schemes and feedback will also be taken from the people regarding the schemes.

Supreme Court stopped the High Court order on this basis


  • A bench of Chief Justice Surya Kant and Justice Joymalya Bagchi issued an interim order on the state’s special leave petition against the High Court’s decision. The bench has also issued notice to the petitioners who filed a petition against the government’s plan in the High Court.

  • Counsel for the petitioners alleged that the government was taking the help of government employees and party workers to conduct a public relations campaign before the elections.

  • Senior advocate Kapil Sibal, appearing for the state government, said that not even a single penny has been given to CPIM workers in the state.

  • The CJI said that prima facie, there is nothing wrong if the state government takes the help of government employees to ascertain the ground level impact of welfare schemes.

what did the high court say


  • On February 17, the High Court quashed the government order to release Rs 20 crore for the Neo Kerala Citizen Response Programme. The court called it a misuse of executive powers and also called it a violation of the rules of business.

  • A bench led by Chief Justice Soumen Sen of the High Court had expressed concern that the budget allocation of departments was not being fully followed and even the rules for creating financial discipline were being ignored.

  • The petitioners said that the government is misusing public funds for political gains.

  • The High Court held that the order of the Department of Information and Broadcasting allowing utilization of Rs 20 crore was factually incorrect and could not be sustained due to clear violation of budget allocation.
